In my estimation, Congress left out the word "current" because they could
envision that a move against a former official could, in some instances, be
entwined in a current official proceeding. Other than that, there is no reason
to believe that there was any concern that if an official had left office that
a move against them might entail interference with official processes. Thus
the law was designed solely to keep states out of federal business.
