The Access Hollywood tape was the "match" that lit the fire under the
affairs Trump had with porn stars because at that point in time all that
was known about how such fare would be received by the public was
the "Monkey Business" matter that sank Gary Hart. Moral Turpitude
and Marital Infidelity were terrifying labels for any candidate let alone
one for the Presidential office.
Trump antics already backfiring on his criminal defense as no one trusts...
Back in 2016 the memory of "Monkey Business" would make any
candidate terrified of having the words: "Marital Infidelity and Moral
Turpetude" associated with their campaign, thus the need to cover up
is provoked by an overwhelming fear of impending doom such that
6 figure checks were cut with glee.

Trump on trial: New York vs. Donald Trump day 1 Highlights
Stormy Daniels is evidence in this case because the actual cases is
about the illegal actions the defendant took to conceal adverse facts
from the electorate that was trying to evaluate his qualifications for
the office of the President. For reasons that will be given at trial,
the Defendants' calculation at the time was that marital infidelity
and moral turpitude would be so repulsive to the public that it
had to be concealed if the defendant was going to have a reasonable
chance of winning the election. But, after learning how much scrutiny
a Presidential candidate/winner would be under, the defendant decided
that the cover-up needed to be covered up as well. So, it is these
cover-ups that are being charged and thus what is being called "lesser
and included charges", cannot be dismissed or pleaded to alone because
they are the evidence that makes the coverups crimes.

Supreme Court SLEEPER HEARING has MAJOR IMPLICATIONS on Trump
It seems to me that Congress was intent on preventing obstruction
of government operations as well as preventing financial fraud. To
this effect they used "or" to reflect that "either this or that" would
be a violation of this statute.
