Stormy Daniels is evidence in this case because the actual cases is
about the illegal actions the defendant took to conceal adverse facts
from the electorate that was trying to evaluate his qualifications for
the office of the President. For reasons that will be given at trial,
the Defendants' calculation at the time was that marital infidelity
and moral turpitude would be so repulsive to the public that it
had to be concealed if the defendant was going to have a reasonable
chance of winning the election. But, after learning how much scrutiny
a Presidential candidate/winner would be under, the defendant decided
that the cover-up needed to be covered up as well. So, it is these
cover-ups that are being charged and thus what is being called "lesser
and included charges", cannot be dismissed or pleaded to alone because
they are the evidence that makes the coverups crimes.
