The judge ruled this way as a standard operating procedure to fast-track
the case to the Supreme Court, all it takes is for the intermediate courts
to leave the ruling alone and up it will go swiftly to the USSC.

The matter is not that Biden mislitterates, but that he demonstrates time
after time, in situation after difficult situation, that he is a highly skilled
and competent political operative who has and can get much of his agenda
done, even despite heavy odds and opposition against him. That is no mean
feat and it trumps any claims that the effects of aging might bring to the
proverbial table.

It is painfully obvious to me that the judge did not want to be the end
of the matter, but wanted the matter to receive wider attention in the
hands of a higher court. He did his work locking down the matter of
responsibility (read guilt), then putting in place a remarkably reversible
decision that will, no doubt be taken advantage of by a higher court.
Actually, by upper courts not overturning the end ruling they could
fast-track the matter to the USSC, where a ruling would bind the entire
nation.
