It is painfully obvious to me that the judge did not want to be the end
of the matter, but wanted the matter to receive wider attention in the
hands of a higher court. He did his work locking down the matter of
responsibility (read guilt), then putting in place a remarkably reversible
decision that will, no doubt be taken advantage of by a higher court.
Actually, by upper courts not overturning the end ruling they could
fast-track the matter to the USSC, where a ruling would bind the entire
nation.
