I think Merrick Garland is being careful since this Supreme Court is stacked full of radicals who will stop at nothing to "prove" their legal fantasies. If Merrick were to lose one serious case, it would be the complete failure of the "rule of law" resulting in a possible "Idi Amin Dada and President for Life" taking office here. Israel can't save us because we don't have an Entebbe here.
