"Playing it safe" is not the name of the game at Justice, Elliot Ness didn't do it and neither did Giuliani (although all of his mob cases were overturned for "overzealous prosecution") But real prosecutors know that juries are not brain dead, juries have smarts and can be relied upon to figure out when they're being snowed or not and by whom. There's no magic involved, if you have a good and convincing case then try it, let the jury decide.
