While a single piece of circumstantial evidence is easily controverted, when you have several pieces of such evidence that all have the same goal and they converge with several people working for the same goal and in communications with each another, that circumstantial evidence ceases to be controversial. Merrick Garland needs to take the advice of experienced and successful line prosecutors both serving and ex or retired and move his case(s) based on their collective judgment alone. He must remember he is not just fighting some run-of-the-mill crime(s), but treasonous crimes committed in the attempt to ruin the Constitutional republic that constitutes the American Government itself.
