He's not charged with providing "fringe benefits" he's being charged with tax evasion and falsifying company documents to conceal substantial compensations being paid "under the table" so as to avoid tax consequences on both ends of the scheme.  Either Alan is an embezzler who took these valuable things without Trumps knowledge or approval, or Trump approved of it and is therefore guilty of a conspiracy to evade taxes.
