Going to court is merely a delaying tactic because Congress has the right, the power and the duty under the Constitution to be a check and balance against the Executive.  Congress would not be an effective check or balance if they had to wait for court rulings while the President does not.  Because that would make it impossible for the Congress to act as an equal to the executive.  As we can see, court challenges are making it well neigh impossible for the Congress to obtain what it needs to oversee the executive.  If this is allowed we have a dictatorship right now.
