Since the deal was not made in accordance with the applicable laws governing the making of such a deal, the deal was illegal. As such, an illegal deal cannot have the force of law. It's, essentially as if the prosecution made a deal and accepted a plea of guilty, then sent the accused off to prison without ever submitting the matter to a court for judicial review and approval. In fact, anyone who knowingly participated in such an exercise would be criminally liable.
