What Accosta did was illegal according to the law. While prosecutors have a certain immunity in the performance of their job, that does not cover them for intentionally committing crimes, for example Accosta could not claim prosecutorial immunity to cover him for taking a bribe. So, he should not be covered for committing an illegal deception and keeping that information from the Judge who is charged with reviewing his work for approval/rejection.
